Terms of Service
These Terms of Service ("Terms") are an agreement between you and QOWeb.AI ("QOWeb," "we," "us" or "our"), a Quantum Outbound company. They govern your use of qoweb.ai, the QOWeb dashboard at myqoweb.com, and our website build, hosting and maintenance service (together, the "Services"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you use the Services for a business, you agree on its behalf and confirm you have authority to do so.
1. The Services
QOWeb uses artificial intelligence to generate and build a website for your business, hosts it on managed cloud infrastructure, and maintains it while your subscription is active. Maintenance covers keeping the platform and hosting environment updated, secure and backed up. It does not include creating new content, redesigning your site or building custom features unless we agree to that in writing. You can edit your site yourself at any time using the AI editor or visual editor in your dashboard.
We may change, add or remove features over time. If we make a change that materially reduces the core Services you pay for, we will tell you in advance.
2. Your account
You must be at least 18 years old and able to form a binding contract to use the Services. Give us accurate information and keep it up to date. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us right away at contact@quantumoutbound.ai if you suspect unauthorized access.
3. Subscription, billing and cancellation
- Price: the Services cost $150 per month, plus any applicable taxes, unless a different price is shown when you sign up.
- Automatic renewal: your subscription renews automatically each month, and you authorize us to charge your payment method at the start of each billing period until you cancel.
- Cancellation: you can cancel at any time from your dashboard or by emailing us. Cancellation takes effect at the end of your current billing period, and your site stays live until then.
- Refunds: payments are non-refundable, and we do not give refunds or credits for partial months, except where the law requires otherwise.
- Failed payments: if a payment fails, we may suspend your site after notifying you until the balance is paid.
- Price changes: we will give you at least 30 days' notice before a price change takes effect. If you don't agree, you can cancel before the new price applies.
4. Your content
"Your Content" means everything you provide or create through the Services, including prompts, text, images, logos, files and your website itself. You keep ownership of Your Content. You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, display and adapt Your Content only as needed to provide, secure and improve the Services.
You confirm that you have the rights to Your Content and that it, and your website, comply with the law and these Terms. You are responsible for your website, including any products, services, claims and visitor data on it, and for providing your visitors with any privacy notice, terms or disclosures the law requires.
5. AI-generated content
Sites, text and images generated by AI may contain errors, may not be unique, and may resemble material created for others. Review everything before you publish it and make sure it is accurate and appropriate for your business. To the extent we have any rights in AI-generated output created for your site, we assign them to you, subject to the rights of third parties and the licenses of any stock media or software included.
6. Acceptable use
You may not use the Services to:
- break any law, or infringe anyone's intellectual property, privacy or other rights;
- host or distribute malware, phishing pages, spam, or content that is fraudulent, deceptive or harmful;
- publish content that is sexually exploitative of minors, promotes violence or harassment, or is otherwise unlawful;
- sell illegal goods or services;
- interfere with or overload the Services, attempt to gain unauthorized access, or probe or test their vulnerability without our written permission;
- resell or white-label the Services without our written agreement.
We may remove content or suspend a site that we reasonably believe violates these Terms or creates risk for us or others. Where practical, we will notify you first.
7. Domains and third-party services
You can connect a domain you own. You are responsible for registering and renewing it and keeping its DNS settings correct. The Services rely on third-party providers, including our website-building and hosting platform, content delivery and security networks, payment processors and AI providers. Plugins, integrations and other third-party products you add to your site are governed by their own terms, and we are not responsible for them.
8. Our property
The Services, including our software, dashboard, templates, designs, branding and the QOWeb name and logo, belong to QOWeb, its affiliates or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Services during your subscription. If you send us feedback or ideas, we may use them without any obligation to you.
9. Termination and your data
You may cancel at any time as described in Section 3. We may suspend or end your access if you materially breach these Terms, fail to pay, or if we are required to by law, and we may stop offering the Services with at least 30 days' notice. When your subscription ends, your website will be taken offline. We will keep Your Content for 30 days so you can ask us for a copy, and may then permanently delete it, including from backups on their normal schedule. Sections 4, 5, 8 and 10 through 14 survive termination.
10. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent the law allows, QOWeb disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. Uptime and performance figures we publish describe our targets and our providers' infrastructure, not a guarantee. We do not warrant that the Services will be uninterrupted, error-free or secure, that AI-generated content will be accurate, or that your website will achieve any particular search ranking, traffic or business result.
11. Limitation of liability
To the fullest extent the law allows, QOWeb and its affiliates, officers, employees and providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Services. Our total liability for all claims relating to the Services will not exceed the amount you paid us in the three months before the event giving rise to the claim.
Some jurisdictions do not allow certain disclaimers or limits, so some of the above may not apply to you.
12. Indemnity
You will defend and indemnify QOWeb and its affiliates against third-party claims, damages and costs (including reasonable attorneys' fees) arising from Your Content, your website, your business, or your violation of these Terms or the law.
13. Governing law and disputes
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in [STATE], and you and QOWeb consent to their jurisdiction. Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other for at least 30 days.
14. General
- Changes: we may update these Terms. We will post the new version here with a new effective date and give you notice of material changes by email or in the dashboard. Continuing to use the Services after changes take effect means you accept them.
- Entire agreement: these Terms and our Privacy Policy are the whole agreement between you and QOWeb about the Services.
- Severability and waiver: if any part of these Terms is unenforceable, the rest stays in effect. Not enforcing a provision is not a waiver of it.
- Assignment: you may not transfer these Terms without our consent. We may transfer them to an affiliate or as part of a merger, acquisition or sale of assets.
- Force majeure: we are not responsible for delays or failures caused by events outside our reasonable control.
